On June 5, 2024, Department of Transportation Commissioner Ydanis Rodriguez announced the impending deadline for restaurant owners to apply for the permanent outdoor dining program, “Dining Out NYC.” Restaurants with an existing outdoor dining set-up have until August 3rd to apply to participate in the permanent program or remove their set-ups.
On May 9, 2024, the Landmarks Preservation Commission approved rule amendments dealing with sidewalk and roadway cafes. Almost two years after the City Planning Commission’s zoning text changes, applications for the permanent program are expected to open next month. On February 2, 2024, the Department of Transportation released the final rules for the permanent outdoor dining program, “Dining Out NYC.” Through the new program, outdoor dining will be expanded citywide on sidewalks year-round and in roadways seasonally from April through November.
